01About these Terms
furthermarkets.com (the “Site”) is operated by Further Markets Technologies Ltd (“FurtherMarkets”, “we”, “us” or “our”), a private company incorporated in the Dubai International Financial Centre (“DIFC”) under the DIFC Companies Law, registration number 11741. Our office is at DIFC Innovation Hub, Innovation One Building, 3rd Floor, Dubai AI Campus, Dubai, United Arab Emirates.
These Terms of Use (“Terms”) govern your access to and use of the Site, including FurtherMarkets papers and any other material made available through it (“Content”). By accessing or using the Site, you agree to these Terms. If you use the Site for an organisation, you confirm that you have authority to bind that organisation. If you do not agree, do not use the Site.
The Site is intended for business and professional use. Nothing in these Terms excludes any mandatory right or remedy that applicable law does not allow the parties to exclude.
02Regulatory status and no advice
Further Markets Technologies Ltd is not authorised or regulated by the Dubai Financial Services Authority (“DFSA”) to provide Financial Services. The DFSA has not reviewed or approved the Site or its Content.
We do not provide, arrange or execute investments or other financial products, and we do not provide investment, financial, legal, tax or accounting advice. The Content is general research and market intelligence only. It is not tailored to you and does not take account of your objectives, financial situation, needs or circumstances.
Nothing on the Site is an offer, solicitation, invitation, inducement, endorsement or recommendation to buy, sell, hold, subscribe for or dispose of any security, financial instrument, investment or other financial product, to enter into any transaction, or to use any financial service or pursue any strategy.
You are responsible for your own decisions. Do not act or refrain from acting solely because of the Content. Obtain independent advice from appropriately authorised and qualified professionals and verify information from primary sources before making a business, legal, tax, accounting, financing or investment decision.
03Who may use the Site
The Site is intended for business and professional readers aged 18 or over. It is not directed at any person, or for use in any jurisdiction, where accessing, distributing or using the Site or Content would be unlawful. You are responsible for complying with the laws that apply to your access and use.
04Our Content and permitted use
The Site and Content—including text, data, charts, maps, scorecards, papers, images, videos, designs and their selection and arrangement—are owned by or licensed to FurtherMarkets and are protected by copyright, database right, trade mark and other intellectual-property laws.
Provided that you comply with these Terms, you may: (a) read the Content; (b) download and print Content for your personal business information or internal use within your organisation; (c) share a link to a public page on the Site; and (d) quote short extracts with accurate attribution to FurtherMarkets, without altering their meaning or context.
Unless we have first agreed in writing, you must not: (a) republish, sell, license, rent, distribute or make available all or a substantial part of the Content; (b) upload a paper to another website, platform or shared library; (c) remove or alter a copyright notice, source line, disclaimer or branding; (d) present the Content or anything derived from it as your work or as advice given by FurtherMarkets; (e) use robots, scrapers, crawlers or other automated means to copy, monitor or extract Content or data systematically, except for a public search engine indexing public pages solely for search results; (f) use the Content to train, test, evaluate or improve an artificial-intelligence or machine-learning model, or to create a database or dataset; or (g) circumvent a technical access restriction.
We expressly reserve our rights in relation to text and data mining. The restrictions in this section apply to the fullest extent permitted by law and do not restrict an act that applicable law expressly permits and does not allow us to prohibit by contract. Any other use requires our prior written permission.
05Names and marks
The names FurtherMarkets, FurtherAfrica, FurtherAsia, FurtherArabia, FurtherBrazil, League of Africa and FM Studio, and their associated logos, are owned by us or used by us under licence. You must not use them in a way that suggests an affiliation with or endorsement by FurtherMarkets, or that is misleading, without our prior written permission. No licence to use a name, logo or mark is granted except as expressly stated in these Terms.
06Requesting a paper
To request a paper, you must provide accurate information requested by the form. A download link is for the person who requested it and must not be shared or used to bypass the Site’s access process. Share the public paper page instead so another person can request their own copy.
Requesting a paper does not subscribe you to marketing. We will send new papers only if you separately select the optional subscription box and complete the confirmation process. Our Privacy Policy explains how we handle personal data.
07Translations
Some pages and papers may be available in more than one language. A translation is provided for convenience. To the extent permitted by applicable law, the English version prevails if there is an inconsistency. Mandatory local-language or other legal requirements remain unaffected.
08Accuracy, dates and forward-looking Content
We seek to use reliable sources and reasonable review processes. Each paper should be read by reference to its stated research cut-off date. Markets and circumstances change, and third-party data may be incomplete, revised, delayed or incorrect. To the fullest extent permitted by law, we do not promise that the Site or Content is accurate, complete, current or suitable for a particular purpose, and we are not obliged to update Content after publication.
Scenarios, outlooks, forecasts, estimates and other forward-looking Content describe possibilities, not promises or guarantees. Actual outcomes may differ materially. Any figure identified as a FurtherMarkets estimate is based on the stated inputs and assumptions and remains subject to uncertainty.
Our research may be prepared with technology that includes artificial-intelligence tools and is subject to our editorial review process. It can still contain errors. If you identify a possible error, please contact us under section 17.
09Requests and separate engagements
Sending a request or message does not create a client, advisory, fiduciary, confidential or other professional relationship, and does not require us to accept or respond to it. Do not send confidential, privileged or commercially sensitive information through the Site. We do not assume a duty of confidence merely because you send information through a form.
Any work that we agree to perform will be governed by a separate written agreement signed or otherwise expressly accepted by both parties. That agreement will prevail over these Terms for that work.
10Responsible use
You must not: (a) use the Site unlawfully, fraudulently, deceptively or harmfully; (b) infringe another person’s rights; (c) gain or attempt to gain unauthorised access to the Site, a server, account or connected system; (d) test or bypass security or an access control without written authority; (e) introduce malware or harmful code; (f) impose an unreasonable or disproportionately large load, including through automated requests; (g) submit false details or impersonate another person; or (h) use a Site form to send spam or unsolicited commercial messages.
We may restrict, suspend or terminate access if we reasonably believe that these Terms have been breached, or where reasonably necessary to protect the Site, our rights or another person.
11Third-party and regional sites
The Site may link to our regional platforms and to third-party websites or sources. Their terms and privacy notices apply when you use them. We do not control and are not responsible for third-party content, availability, security or practices. A link does not by itself mean that we endorse the linked person, product, service or view.
12Availability and changes
We aim to operate the Site with reasonable care, but do not guarantee that it will always be available, uninterrupted, secure or error-free. We may change, suspend, restrict or withdraw any part of the Site or Content at any time. You are responsible for using appropriate device, browser, network, security and backup arrangements.
13Our liability
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, deliberate misconduct, or any other liability that applicable law does not permit us to exclude or limit.
Subject to the paragraph above and to the fullest extent permitted by law, the Site and Content are provided free of charge, “as is” and “as available”. We exclude all representations, warranties, conditions and other terms that are not expressly stated in these Terms, including implied terms concerning accuracy, completeness, availability, satisfactory quality, fitness for a particular purpose and non-infringement, to the extent their exclusion is lawful and reasonable.
Subject to the first paragraph of this section, neither FurtherMarkets nor its officers, employees or contributors is liable for: (a) loss of profit, revenue, business, opportunity, anticipated savings, goodwill or data; (b) investment, trading, financing or transaction loss; or (c) indirect, special or consequential loss, arising from or connected with the Site or Content, whether in contract, tort (including negligence), breach of statutory duty or otherwise, even if the possibility of loss was known.
Subject to the first paragraph of this section, our total aggregate liability for all direct loss arising from or connected with the Site, Content or these Terms is limited to AED 1,000. The parties acknowledge that this allocation of risk is reasonable in light of the Site being free, general and not tailored, and because you control whether and how you rely on the Content.
14Your responsibility to us
You are responsible for your use of the Site and Content. If your material breach of these Terms or unlawful use directly causes us reasonable loss, cost or expense, you must compensate us for that direct amount, including reasonable legal costs. You are not responsible under this section to the extent that the loss was caused by our act or omission.
15Privacy
Our Privacy Policy explains how we process personal data in connection with the Site. It is provided as a privacy notice and does not form part of the contractual Terms.
16Changes to these Terms
We may update these Terms by publishing a revised version on the Site. A change applies to your use from its stated effective date and not retroactively. We may highlight a material change on the Site. Please review the last-updated date when you use the Site.
18General
If a provision of these Terms is invalid or unenforceable, it will be treated as modified to the minimum extent necessary, and the remaining provisions will continue in effect. A delay or failure to enforce a right is not a waiver. You may not transfer your rights or obligations under these Terms. We may transfer ours in connection with a reorganisation, financing, sale or transfer of the Site or our business, provided this does not reduce any mandatory right you have.
These Terms are the entire agreement between you and us concerning use of the Site and replace earlier website terms. Our officers, employees and contributors may enforce section 13; otherwise, a person who is not a party has no right to enforce these Terms.
19Governing law and courts
These Terms and any dispute or claim arising out of or in connection with them or the Site, including a non-contractual dispute or claim, are governed by DIFC law. The DIFC Courts have exclusive jurisdiction. This does not exclude a mandatory law, right, remedy or jurisdiction that the parties cannot lawfully exclude.
